Franklin Foto Discrimination/Harassment Policies & Code of Conduct

Franklin FOTO (FF) is committed to freedom from discrimination

for all members, users and guests of our community.

FF expressly prohibits discrimination on the basis of race, color, national origin, age, perceived or actual physical or mental disability, pregnancy, genetic information, sex, sexual orientation, gender identity, marital status, creed, or religion.

In addition, FF is committed to freedom from all forms of harassment.

All claims of discrimination and harassment will be promptly investigated.

Franklin FOTO recognizes its responsibility for investigation, resolution, implementation of corrective measures, and monitoring the creative and educational environment to stop, remediate, and prevent discrimination and harassment.

To this end, FF has enacted policies prohibiting discrimination against

and harassment of members, users and guests of our community.

Any individual found to be in violation of these policies will be subject to disciplinary action up to and including exclusion from activities, loss of usage and/or termination of membership.

In order to maintain a safe and inclusive environment,

all members, users and guests agree to the following:

• We will treat each other with respect, kindness and compassion.

• Discrimination and harassment of any kind are prohibited.

• Belligerent acts including physical violence, yelling, name-calling and

offensive language are prohibited.

• Possession of firearms or other dangerous weapons is prohibited at all activities.

• Usage of alcohol, drugs, tobacco or electronic cigarettes is not permitted at our facility

(with the exception that alcoholic beverages may be permitted at special events).

• All equipment and supplies will be treated with care and respect; users agree to follow all verbal and written instructions, and to report any problems or accidents immediately.

• All users must first complete the facilities orientation, and sign this form, before being permitted to use the equipment and supplies.

I, the undersigned, have read all the above policies and code of conduct,

and agree to adhere to them. In addition, I have completed the facilities orientation.

WAIVER AND RELEASE FORM

I hereby acknowledge that I have voluntarily chosen to participate in activities at the community darkroom and studio operated by: Franklin Foto LLC in Portland, Oregon.

ASSUMPTION OF RISK: I understand that working in a darkroom involves inherent risks. I freely assume all such risks, both known and unknown, even if arising from the negligence of Franklin Foto or others, and assume full responsibility for my participation.

WAIVER AND RELEASE: In consideration of being permitted to participate in darkroom activities, I hereby waive and release Franklin Foto, its officers, employees, and agents from liability for any and all claims resulting from participation in the community darkroom and studio activities.

INDEMNIFICATION AND HOLD HARMLESS: I agree to indemnify and hold Franklin Foto harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney's fees brought as a result of my involvement in the community darkroom and studio activities.

USE OF EQUIPMENT: I understand that I am responsible for the proper use of all darkroom equipment. Any damage caused by my misuse or negligence will be my financial responsibility.

ADHERENCE TO RULES: I agree to comply with all rules and regulations of Franklin Foto regarding the use of the community darkroom. I understand that failure to follow these rules may result in the termination of my darkroom privileges.

SEVERABILITY: I agree that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Oregon and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I, the undersigned, having read and understand the entirety of this agreement, hereby agree to its terms.
